1. Agreement to these Terms

By downloading, accessing, or using the Takeform iOS application, website, or related services (collectively, the “Services”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Services. “Takeform,” “we,” and “us” refer to the developer and operator of the Services.

2. Eligibility and accounts

You must be at least 13 years old, or the minimum age required by local law to use the Services without parental consent. If you use Takeform for an organization, you represent that you have authority to accept these Terms for that organization.

You are responsible for maintaining the confidentiality of your device and account credentials and for activity under your account. Provide accurate information and notify us if you believe your account has been compromised.

3. Your right to use Takeform

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for lawful personal or internal business purposes in accordance with these Terms and Apple’s applicable usage rules. We retain all rights in Takeform not expressly granted to you.

4. Your content

You keep ownership of the photos, videos, audio, prompts, brand assets, and other content you provide (“User Content”). You grant us a limited license to host, copy, process, modify, and transmit User Content only as reasonably necessary to operate, secure, improve, and support the Services and to perform the edits or cloud features you request.

You represent that you have the rights and permissions needed to use User Content with Takeform and to create, export, and share the result. This includes permissions relating to copyright, trademarks, music, privacy, publicity, and people appearing in the content.

5. AI-assisted features and outputs

Takeform may use automated systems to suggest story structure, select moments, create draft plans, generate supporting content, or apply your edit instructions. Outputs may be inaccurate, incomplete, unexpected, or similar to content generated for others. AI-assisted output is not professional advice and should be reviewed before use.

Takeform does not promise that a video will go viral, reach a particular audience, avoid every third-party claim, or produce a specific business result. Platform distribution depends on many factors outside our control.

6. Acceptable use

You may not use the Services to:

• Violate law or another person’s rights.
• Create or distribute unlawful, abusive, deceptive, exploitative, or non-consensual intimate content.
• Impersonate others deceptively or misrepresent synthetic or altered media where disclosure is required.
• Upload malware, probe security, interfere with service operation, or evade usage or access controls.
• Reverse engineer, resell, scrape, or use the Services to build a competing dataset or model except where applicable law expressly permits it.
• Use the Services in a way that creates material risk to people, property, or critical systems.

We may investigate suspected misuse and suspend or terminate access where reasonably necessary to protect users, third parties, or the Services.

7. Subscriptions, billing, and cancellation

Some features require a paid Takeform Pro subscription. Prices, introductory offers, billing periods, and included features are shown in the app before purchase and may vary by storefront. Purchases are processed by Apple through your App Store account.

A subscription renews automatically unless you cancel it through your Apple Account settings at least 24 hours before the end of the current billing period. Apple manages billing, cancellation, and refund requests under its policies. Deleting Takeform or your Takeform account does not automatically cancel an Apple subscription.

We may change subscription features or future prices as permitted by law and Apple’s rules. Any price change will apply with the notice and consent required by the App Store and applicable law.

8. Third-party services

The Services may rely on or link to third-party services, including Apple, Google/Firebase, Google Cloud, RevenueCat, and sharing destinations you choose. Their terms and privacy policies govern their services. We are not responsible for third-party content, availability, or actions outside our control.

9. Takeform intellectual property

The Services, including software, design, trademarks, graphics, and other Takeform materials, are owned by us or our licensors and protected by intellectual property laws. Feedback you voluntarily provide may be used without restriction or compensation, provided we do not identify you publicly without permission.

10. Changes and availability

We may add, modify, limit, or discontinue features and may release experimental or beta functionality. We do not guarantee that every feature or project will always be available, error-free, or compatible with every device, media format, or third-party platform. Keep copies of content you need.

11. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Takeform and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid for Takeform during the 12 months before the event giving rise to the claim or US$100.

These limits do not apply where prohibited by law or to liability that cannot legally be limited. Mandatory consumer rights remain unaffected.

13. Suspension and termination

You may stop using the Services at any time and may delete your account from the app. We may suspend or terminate access if you materially or repeatedly violate these Terms, create legal or security risk, or if we discontinue the Services. Where appropriate, we will provide notice and an opportunity to export available content.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, and dispute provisions—will survive.

14. Applicable law and disputes

These Terms are governed by applicable law, without regard to conflict of laws principles. The courts with jurisdiction under applicable law may hear disputes. Nothing in this section limits any mandatory right you may have to bring a claim in your place of residence or use an available consumer dispute process.

15. Changes to these Terms

We may update these Terms as the Services evolve. We will post the new effective date and provide additional notice when a change is material and required by law. Continuing to use the Services after updated Terms take effect means you accept them, where permitted by law.
